Payment Services Agreement for Telefans

Introduction

This Payment Services Agreement (« Agreement ») outlines the terms under which Telefans offers payment processing services through our Telegram bot in partnership with Stripe.

1. Acceptance of Terms

  • Consent: By using our payment services, you agree to the terms of this Agreement.
  • Eligibility: You must be legally eligible to enter into this Agreement and use payment services.

2. Payment Processing Services

  • Service Description: We provide a platform for users to process payments for content sold through Telegram channels.
  • Stripe Integration: Our service uses Stripe for secure payment processing. Users are subject to Stripe’s terms and conditions.

3. User Responsibilities

  • Account Information: You are responsible for providing accurate account information for payment processing.
  • Legal Compliance: Ensure that all transactions comply with relevant laws, including those pertaining to financial transactions and data protection.

4. Fees and Charges

  • Service Fees: Telefans retains a fee of 15% on all client sales transactions.
  • Stripe Fees: Note that additional fees may be incurred through the use of Stripe’s services.

5. Payment and Settlement

  • Transaction Processing: Clients pay for products via a Stripe webhook. Funds are held in our Stripe instance. Upon withdrawal request by a user, we transfer the funds to the bank information provided by the client, typically within 15 days.
  • Settlement of Funds: Users can view their account balance at any time by issuing the corresponding command to the bot. However, funds are virtually held in the Stripe account of telefans.app.

6. Refund and Chargeback Policy

  • Refund Policy: Users may request refunds within a specified period (e.g., 14 days) from the date of purchase, provided the content has not been significantly consumed or downloaded.
  • Chargeback Process: In the event of a chargeback, Telefans will investigate the claim. Users may be temporarily suspended during this investigation. Chargebacks found to be valid may result in reversal of funds.

7. Data Protection and Fraud Prevention

  • Data Security: We are committed to protecting your personal and payment information in compliance with data protection laws.
  • Fraud Prevention Measures: Regular monitoring for suspicious transactions, two-factor authentication, and encryption of sensitive data are employed to prevent fraud.

8. Termination and Suspension

  • Service Termination: Either party may terminate this Agreement with notice. Termination may result from violations of this Agreement or for other legal or operational reasons.
  • Account Suspension: Accounts may be suspended for violations of this Agreement, suspicious or fraudulent activities, or as required by legal or regulatory authorities.

9. Limitation of Liability and Disclaimer

  • Liability Limitation: Limit the extent of Telefans’ liability concerning payment services.

  • Policy Updates: We reserve the right to modify this Agreement.
  • Notification: Users will be notified of any significant changes to this Agreement.

11. Governing Law and Jurisdiction

  • Applicable Law: This Agreement is governed by Switzerland’s laws.
